CANDIDATE JIM SCHNELLER FILES MOTION TO STRIKE THE G.O.P.'s PETITION TO SET ASIDE HIS NOMINATION 


    Jim Schneller, candidate for U.S. Representative for the 7th district of  Pennsylvania, filed Monday a motion to strike the petition to set aside the Jim Schneller candidacy.

"We formally requested the Meehan campaign to withdraw their petition last Wednesday.   The petition is a mish mosh of claims that either don't belong in a signature challenge, or make one of the weakest cases for line-by-line signature disqualification ever filed.  This request has been refused.

    Thus we filed today preliminary objections to the petition, including motions to strike each of the major counts in the petition."

    The motions make three major points in requesting striking or quashing of the G.O.P. petition:

1) the Commonwealth Court has no jurisdiction over any allegations of Democrat efforts to bolster the number of Schneller signatures, and in  prior cases the Court has always refused to hear such irrelevant claims.  Even if they did belong in a Courtroom, the claim does not come anywhere near stating the necessary detail and legal basis why the alleged activity should denigrate the Schneller campaign.

2)  the GOP petition is fraught with scandalous, unfounded, arbitrary, and meaningless claims and is thus worthy of dismissal prior to trial.


3) the G.O.P., in order to prevail in their attempt to disqualify a sufficient number of petition signatures so as to remove Jim Schneller from the ballot, would need a 94 % or higher success rate of proving why each signature they claim to be defective is really defective.  This is unheard of and impossible.


   With these three claims nearly proven, even without any hearing, the Schneller campaign is confident that the Commonwealth Court will stop the case from proceeding further.  If permitted to proceed, the case would clog the Court with a legal action having no real purpose but to waste the Jim Schneller campaign's time and capital.

   The motions also object that Pat Meehan or the GOP should be one of the objectors, especially since their petition is a violation of the Election Code in it's vagueness and it's attempt to misuse the law, and they are already under investigation for perjury or fraud in their nominating petition.  Likewise, the Schneller for Congress objections accuse the Meehan camp and the GOP, if not both major parties, of violation of the Election Code's prohibition on duress and intimidation and interference with the free exercise of the elective franchise.

    The candidate concludes:  "Remember,  both parties seek to lowball Jim Schneller in any way possible.   Seeking to remove a candidate from the ballot with false accusations and exaggeration is un-American, and is legal bullying.   Notice that both parties have used their signature/petition issues to classify me as "right-wing" and other labels.  These were mainly attempts to relegate me to a small corner where they could have had an easier time falsifying my position.  

     I recommend that all voters visit my website, to see how solid a candidate I am, and how much closer I am to winning than any official will admit.   These two major parties want to run a mudslinging contest.   I want the public to see that I will act like an American in office, not a party rank and file !


    This is not the usual election !  America is in dire straights, and both of the big two parties are deeply involved and fully liable for our predicament.  Do you really need any more evidence that the political machines will continue to ignore us, when even our simplest needs like ballot access, non-deficit spending,  jobs, and an end to harrassing litigation, are ignored and stepped on by both candidates ?   

    A vote for Jim Schneller is a vote to stop a runaway train, and citizens ought to see the Jim Schneller candidacy as a crucial opportunity."
