Jim Schneller for Congress Campaign Fights For Debate Inclusion, Claims Conspiracy, and Reminds Candidates that the 2010 Election Is Not Business-As-Usual

  The Jim for Congress campaign actively challenged Channel 10 and candidates Lentz and Meehan to include Jim in the @Issue debate originally scheduled for today, in the US district court, on Wednesday, and in the Third circuit federal appeals court on Thursday.  


  All the defendants could say in defense was an erroneous claim that Jim Schneller's only recourse was to file with the FCC.   The judge, tossing aside the huge claims for conspiracy and First Amendment deprivation, dismissed on the FCC basis.  The appeal, No. 10-3944, is pending, although a one-Judge decision was handed down Friday, before the taping of the show, denying the campaign's motion for restraining order.   

  The Schneller campaign had asked for equal time, in the alternative, but NBC stubbornly wouldn't even discuss this.  If the show appeared watered down, it's probably so they can't be claimed to have had a bona fide debate, in the appeal.  Schneller claims otherwise, and believes the campaign will prevail in the appeal.   Jim for Congress also claims that they will prevail in the  FCC complaint filed a week ago - and have requested that that be on an expedited track, so as to attain resolution before the election.


  The Schneller campaign, disappointed at the need for such a volume of litigation, knows that to fight the wrongs inflicted on Jim is to remind all concerned, especially the electorate, that the entire scenario is not the way the state and federal constitutions intend elections to run ! 

  In the case in the Commonwealth Court, regarding expediting the investigation of the Meehan campaign, Schneller for Congress filed a motion Thursday for a restraining order stopping the Delaware County, Chester County, and Montgomery County election bureaus from preparing the ballots and voting machines, pending resolution of this case.  On Friday, the campaign filed a required brief, which blasts the State Department, the Attorney General, and Meehan and Lentz, for 

a) the continuing collusive efforts to prevent Jim's equal treatment,

b) the intentional prolonging of the case's timetable,  which attempts to bring a conclusion to this case after the election. 

c) the false claim filed against this case claiming excessive delay, where the case itself is claiming excessive delay by all concerned except Jim Schneller, and where any delay was caused by Meehan's hollow attempt to pursue the same sort of action.

d)  the false claim filed against this case claiming that the Schneller campaign has no recourse, where in reality Jim, being a candidate, has abundant standing, and precedent and the statutes indicate that the Secretary of the Commonwealth has clear authority to not certify a candidate while an investigation is ongoing, and clear authority to refuse to certify, in circumstances such as those of this case.

  The case is scheduled for argument on Wednesday, October 6, 2010.
